PERTANGGUNGJAWABAN PIDANA ANAK YANG MENJADI PERANTARA DALAM JUAL BELI NARKOTIKA GOLONGAN I (STUDI PUTUSAN NOMOR 4/PID.SUS-ANAK/2019/PN.MDN)

Abstract

Narcotics are substances that can cause an effect depending on those who use them by inserting the drug into their body, this effect in the form of refraction from eliminating pain, excitement and hallucinations. The circulation of narcotics can hardly be prevented, considering that almost the entire world population can easily get narcotics from irresponsible persons. As for the formulation of the problem, namely How is the Criminal Accountability of Children Who Become Intermediaries in Narcotics Sale and Purchase Category I in Case (No.4 / Pid.Sus-Anak / 2019 / PN.Mdn). This research uses the method of analysis carried out to collect data by means of literature study, secondary sources of legal materials using primary data that focuses on statutory regulations to answer the problems studied. Based on the research that the author did about the Criminal Liability of Children Who Become Intermediaries in Narcotics Sale and Purchase Category I in Cases (No.4 / Pid.Sus-Anak / 2019 / PN.Mdn). So that based on the element of criminal responsibility, the defendant Imam Wijaya Sinaga in other words Imam was declared capable of being responsible for his actions so that the criminal acts he had committed were committed. He was accounted for, namely with a work training sentence for 6 months at the Inspiration House Of Training Center Yayasan Inspirasi Bangsa at Jalan Komplek Pondok Surya Blok I No. 40 Lk I Helvetia Timur Village, Subdistrict of Medan and criminal of job training for 3 (three) months at the Dinas Sosial of North Sumatra Province.
